The socio-ethical bases of justice

When we compare Rawl's theory of justice with the most important contemporary ethical theories (utility, Kant's), we can see the contrast of contents and method. Speaking about contents of Rawl's theory, this theory is aimed against utility. It is possible to achieve social, ethical and legal argumentation. We have to speak about dialectical harmony of analysis of utility and ideals of justice but we can not reach a certain extent between utility and ideals of justice. The Rawl's "original status" is the status of choice of the real justice principles. The "original status" has the strong synthetic character. It must be the best starting point for decision about moral principles. Generality and universal application are the based formal conditions of its choice. When we speak about "theory of justice" as a part of "rational choice", we have to think that this "original status" has higher position than the "native moral point of view". We can not forget verification of practical results of rational choice which has been chosen in "original status".
